The number of complaints, annually submitted by the economic agents, to National Agency for Solving Complaints has increased. This is one of the conclusions, formulated by the Analytical Directorate of the National Anticorruption Center within the "Strategic Analysis on the functionality of the mechanism for submitting appeals, their examination and the decisions adopted by NASC". According to the NAC, the number of public procurement procedures, challenged at the National Agency for Solving Complaints, was 1955, between 2017 (4 months) - 2020 (6 months), and their estimated value is about 12.5 billion lei.
The calculations of the monthly dynamics of complaints show a steady increase, which, from the average of 32 recorded in 2017, reached 70 in 2020. Predictive analysis of the phenomenon of appeals, in such circumstances, shows a trend towards increasing the number in the future.
The study also shows that, from year to year, more and more economic operators resort to the appeal mechanism. Although this significant increase seems to show the confidence of economic operators in the appeal mechanism, on the other hand, the trend must mean an obvious concern for the Government and the Public Procurement Agency, determined by the fact that more and more public procurement procedures are organized with the violation of the rules, in the case of the examined complaints. However, these manifestations of deviations can directly contribute to the generation of acts of corruption with a major impact on the incorrect management of public money.
