An inter-institutional workshop on the criminal assets recovery process is being held on December 7-8 in Chisinau
07.12.2023 82 Views"Mechanisms for the Recovery of Criminal Assets from the Republic of Moldova, Difficulties and Perspectives" is the topic of discussion at an inter-institutional workshop, which will be held on December 7-8 in Chisinau and will be attended by representatives of the Criminal Assets Recovery Agency (CARA) under the NAC.
As speakers, the CARA employees will explain the evaluation of the financial profiles of the subjects (including the beneficial owners), the role and place of parallel financial investigations (concrete identification of assets), planning prior to the application of the seizure.
In the section on the administration of seized assets and criminal bodies, the CARA will present its own experience in the creation of the integrated IT system regarding criminal assets (records of criminal assets during the criminal process), the anticipated sale of seized assets, ensuring optimal storage conditions and recovery of administration costs.
The experts gathered at the workshop, including representatives of similar institutions in Romania, will address the subject of extended confiscation: evaluation of the legal framework, strong points, weak points; the role of continuing professional training in extended forfeiture, the conditions and challenges of applying extended forfeiture. On the information exchange component with foreign jurisdictions, participants will discuss the channels and methods used for the exchange of data and information, the types of information requested and provided, cooperative and non-cooperative jurisdictions, informal data exchange with off-shore areas, overcoming the blockages that have arisen in relations with less cooperative jurisdictions and the non-disposal of criminal assets abroad.
In the same way, the enforcement of confiscation judgments abroad will be discussed: the mechanism for enforcing special confiscation and extended confiscation, as well as the return of assets and their value, the conclusion of cooperation agreements.
To be mentioned that the workshop, organized by the Soros Moldova Foundation, is attended by the NAC officers, prosecutors of specialized prosecutor's offices, representatives of the Service for the Prevention and Combating of Money Laundering in the Republic of Moldova, bailiffs, central public authorities, but also senior advisors, experts, prosecutors and representatives of the similar agency the CARA from the neighboring country - the National Agency for the Management of Seized Assets from Romania.
